WARRANTY CLAIMS.In order to make a warranty claim, contact Dolby Customer Support during the Warranty Period at ProductSupport@Dolby.comor via phone at 1 (866) 994-1446. Information regarding this warranty and warranty claims process is also available at https://www.Products.Dolby.com/Support. A sales receipt, gift receipt, or proof of purchase is required to make a warranty claim. If covered, Customer Support will provide you a Return Material Authorization (RMA) number and provide you detailed information on how and where to send your defective Product. Dolby’s liability, and your sole remedy, for breach of the foregoing Limited Warranty during the Warranty Period will be for Dolby to either (1) repair or, at Dolby’s sole option and discretion, replace the defective Product, at no cost to you, or (2) if Dolby determines that neither of the foregoing are commercially reasonable, refund the amount you paid for the Product. At Dolby’s sole option and discretion, Dolby may use rebuilt, reconditioned or new parts or components when repairing any Product, or may replace the Product with a rebuilt, reconditioned, or new Product. Repaired or replaced Product will be covered by this Limited Warranty for the remainder of the original Warranty Period or 120 days from the shipment date of the repaired or replaced Product, whichever is longer. If any Product is returned to Dolby that is not covered by this Limited Warranty or is returned to Dolby without a RMA Number, then Dolby may, at Dolby’s sole option and discretion, either (i) return the Product at the customer’s expense, or (ii) charge the customer for all parts, shipping, and labor charges for the repair of such Product. Failure to follow the warranty claim instructions may void your warranty.
WARRANTY EXCLUSIONS. This Limited Warranty does not cover damage or malfunctions caused by accident, disaster, misuse (including any use in a manner contrary to the instructions contained in any user guide or on the packaging of the Product), abuse, negligence or other external causes, power surges, improper installation, misadjustment, third-party products, unauthorized opening, unauthorized use, tampering, alteration, or repair or modification by anyone other than Dolby or its authorized servicers. This Limited Warranty also does not cover cosmetic damage or normal wear and tear. This Limited Warranty will be void if the serial number on your Product has been removed, tampered with or defaced or if your Product has been opened or serviced without authorization, tampered with, altered or modified. This Limited Warranty does not cover any claim made after the end of the Warranty Period.
SOFTWARE.Dolby may provide or make available to you software that is compatible with Products. Any such software is provided or made available to you subject to the license agreement accompanying such software or, if no license agreement accompanies such software, then the Dolby end user license agreement available at https://products.dolby.com/dimension/end-user-license-agreement. If applicable, this software is commercial computer software developed exclusively at private expense, and is provided to the US government only as commercial computer software. Use, duplication and disclosure by civilian agencies of the US government shall be in accordance with the terms of such license agreement and FAR 52.227-19(b), or its current equivalent. Consistent with DFARS 227.7202 or its current equivalent, use, duplication and disclosure by DOD agencies is subject solely to the terms of such license agreement.
LIMITATION OF LIABILITY; DISCLAIMERS.THE FOREGOING IS YOUR SOLE AND EXCLUSIVE REMEDY FOR DOLBY’S BREACH OF THE WARRANTY HEREIN OR FOR ANY OTHER CLAIMS RELATED TO THIS WARRANTY. THERE ARE NO EXPRESS WARRANTIES EXCEPT AS LISTED UNDER “LIMITED WARRANTY” ABOVE. ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL BE VALID ONLY DURING THE WARRANTY PERIOD.TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOLBY, ITS AFFILIATES OR ITS SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR OTHER INDIRECT DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE PRODUCT, NO MATTER HOW CAUSED AND ON ANY THEORY OF LIABILITY. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH EVENT, THE FOREGOING LIMATIONS SHALL APPLY TO MAXIMUM EXTENT PERMITTED BY LAW. DOLBY MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE QUALITY, CAPABILITIES, OPERATIONS, PERFORMANCE OR SUITABILITY OF ANY THIRD-PARTY SOFTWARE OR EQUIPMENT USED IN CONNECTION WITH THE PRODUCT. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
GOVERNING LAW.Unless otherwise required by applicable state law, this limited warranty will be construed according to the substantive law, but not the choice of law rules, of the State of California and of applicable federal law of the United States. If any dispute arises under this limited warranty, then unless otherwise required by applicable state law, the venue for such dispute will be in the California Superior Courts and the Federal District Court for the Northern District of California located in San Francisco, California,and customer hereby irrevocably submits to the exclusive jurisdiction of such courts.
